Corneliu-Liviu Popescu, Neconvenționalitatea formală a excluderii Rusiei din Consiliul Europei

Rezumat: Consiliul Europei dispune de o gamă largă de sancțiuni juridice internaționale contra Statelor sale Membre: sancțiunile convenționale statutare, celelalte sancțiuni convenționale și sancțiunile regulamentare. Excluderea unui Stat Membru din Consiliul Europei este sancțiunea cea mai severă, pentru violarea gravă a principiilor fundamentale ale acestei organizații internaționale. Ea are caracter subsidiar față de retragerea din Consiliul Europei a unui Stat Membru în executarea de bună-voie a invitației (cu natură de sancțiune juridică internațională) care i-a fost făcută de a se retrage, precum și față de retragerea voluntară a unui Stat Membru din Consiliul Europei. Pe fond, excluderea Rusiei din Consiliul Europei a fost pe deplin justificată, întrucât a comis un act de agresiune contra Ucrainei, cu violarea gravă a Cartei Națiunilor Unite, așa cum s-a constatat printr-o rezoluție a Adunării Generale a ONU. Totuși, strict din punct de vedere formal, decizia de excludere este neconvențională și nestatutară, întrucât a fost luată atât fără ca înainte să i se aplice Rusiei sancțiunea invitării de a se retrage din Consiliul Europei, cât și după ce Rusia notificase retragerea voluntară din Consiliul Europei. Diferența vizează nu numai natura juridică a încetării calității Rusiei de Stat Membru al Consiliului Europei (retragere voluntară în temeiul suveranității naționale sau excludere ca sancțiune pentru violarea gravă a principiilor Consiliului Europei), ci ea se referă și la diferențe importante privind data efectelor juridice (o diferență de peste 9 luni), prin raportare la calculul contribuției financiare datorate de Rusia pentru bugetul Consiliului Europei, la încetarea calității de Stat Parte la tratatele internaționale adoptate în cadrul Consiliului Europei, la terminarea jurisdicției ratione temporis a Curții Europene a Drepturilor Omului și la încetarea funcțiilor funcționarilor Consiliului Europei având cetățenie rusă.

Rodoljub Etinski, Victims of International Armed Conflicts Should Be Protected by the European Court of Human Rights

Rezumat: The interpretation of Article 1 of the European Convention on Human Rights, according to which acts of war of a party to the Convention committed beyond its territory remain outside the jurisdiction of the party and, thus, beyond control of the European Court of Human Rights is not compatible with a basic concept of human rights which rests on the ideas that human rights are inherent in all human beings and that they are universal. This interpretation is not in accordance with the object and purpose of the European Convention of Human Rights and it degrades effectiveness of the Convention. The interpretation leads to an absurd and unjust result in circumstances of international armed conflict between two parties to the Convention, when the conflict has occurred on the territory of one of them. According to that interpretation, an application against a party on whose territory the armed conflict was occurring would be admissible, but an application against the aggressor State would not be admissible. It is absurd.

 

Daniela-Anca Deteșeanu, Justiția internațională penală în fața situației din Ucraina 

Rezumat: The situation in Ukraine has focused the attention of public opinion on the international courts responsible for the application of international criminal law, seen as effective mechanisms holding accountable those responsible for the violation of the sovereignty of the neighboring state and the violence committed against the civilian population. The article aims to investigate to what extent the International Criminal Court can investigate and prosecute persons suspected of having committed international crimes in the context of these events, what are its limitations of a jurisdictional, procedural or other nature and to what extent there would be alternative mechanisms to satisfy the desideratum of bringing to justice the people who planned, prepared, initiated and ordered the commission of international crimes that have shocked, in recent months, the international public opinion.

Dezideriu Gergely, Evoluția protecției împotriva discriminării pe calea cererilor de trimitere preliminară la Curtea de Justiţie a Uniunii Europene, în temeiul Directivelor 2000/43/CE și privind discriminarea pe baza originii rasiale sau etnice

Abstract:

The paper offers an overview of the requests for a preliminary ruling submitted by the courts to the Court of Justice of the European Union regarding the interpretation of Directive 2000/43/EC and of the evolution of the Court's case-law on the prohibition of discrimination on the basis of racial or ethnic origin. I analyzed the allegations of the parties involved in the cases that were the subject of the applications, the advocate general's allegations before the Court of Justice and the arguments of the Court of Justice that led to the correlative interpretations of Directive 2000/43/EC.    

In the light of the Court of Justice's rulings, I established a number of categories concerning the status of equality institutions that may make requests for a preliminary ruling, the limits of the protection against discrimination conferred on the basis of the criteria prohibited by Directive 2000/43/EC, the scope of the Directive in relation to access to services in the exercise of the functions of public authorities, the punishment of discrimination in the absence of an identifiable victim, the meeting of the criteria of efficiency, proportionality and deterrence of penalties, the scope of the directive in relation to access to education and issues concerning the principle of reversal of the burden of proof.
